Unreal estate: man flips virtual nightclub for $500k

The metaverse doesn’t make the news as often as it did a few years back, but don’t assume that means the glow is off for real profits from virtual worlds: Jon “Neverdie” Jacobs just made a cool half-million bucks on selling an asteroid-cum-nightclub in the Entropia Universe MMO.

Until recently, Neverdie was the owner of one of the hottest virtual properties in Entropia, Club Neverdie, situated on a virtual asteroid around Entropia’s first planet, Planet Calypso. Jacobs bought the virtual asteroid back in 2005 for $100,000, after taking out a mortgage on his real-life house.

Taking out a hundred grand to buy virtual property may have seemed like poor business sense, but Jacobs had a plan. He turned Club Neverdie into a must-visit destination, one that includes more than a dozen bio-domes, a night club, stadium and a mall, where other players flocked to spend real cash on virtual goods and services. Jacobs was making around $200,000 in annual revenue, enough to comfortably support him and his family. Some might wonder why Jacobs didn’t instead start a real-life business like most others. Jacobs’ answer, “games made sense.” Club Neverdie was a “turnkey business” for him — besides dropping in from time to time to check on the property, the business largely ran itself and had no other employees besides himself.

Flipping property has long been an appealingly easy business model for those with enough capital to spare… but not so much in meatspace these days. I think we’ve yet to see the first full-scale metaverse property gold-rush, but once we have, the first metaverse bubble-burst won’t be far behind; in the meantime, a smart chancer can still make their mark on that particular and limitless frontier.

Incidentally, a little further down this piece there’s an interesting and (to me) unexpected junction to another story, namely the J K Rowling plagiarism lawsuit, which gets weirder and weirder the deeper you look into it:

Jacobs wasn’t always a virtual celebrity, but even his past plays out like something out of a movie. His was born to a Miss United Kingdom and Adrian Jacobs, a prototypical Bond villain of sorts. An infamous ’60s British financier nicknamed “Mr. X,” the senior Jacobs was banned from the London Stock Market in the ’80s after a string of shady deals, and has been reportedly quoted as saying, “I’ll be back again, richer than ever!” You can almost hear the super-villain laughter. Adrian Jacobs died in 1997, but in 2009, his estate filed a lawsuit against J.K. Rowling, claiming the author of the Harry Potter series had copied substantial parts of Jacobs’ 1987 children’s book, Willy the Wizard.

Call me cynical, but I’m now even more convinced that the Willy The Wizard suit is an opportunist scam…

My rejoinder to another rejoinder to Doctorow’s rejoinder

Serendipity striketh again, in the form of Helliene Lindvall’s response to Cory Doctorow’s response to her earlier piece  attacking advocates of free-content business models for creatives. The Guardian may be missing a trick, here; this could become some sort of central-court ideology-tennis match. Give ’em a slot each on alternating days, and see how long it runs!

(My money’s on it going the distance; I think the questions around artist business models are currently unanswerable because of the economic flux we’re surfing on. Which is why the debate is important; better to design and build a wall against the coming flood than to wait until the water arrives and provides you with precise design parameters.)

Hell, better yet: set up a video recorder, let ’em do a face-to-face debate, then put it out there for the people to see… right after a lengthy argument about whether to paywall it, natch. (I think there’s a certain subtle irony to Lindvall’s piece appearing in the staunchly free-to-air online version of The Guardian… )

Aaaaanyway, it’s a more reasonable piece than Lindvall’s first, despite a few scare quotes and caricatures (“media gurus”! – is it wrong that I conjure an image of a sadhu with a cellphone when I read that phrase?):

One argument against my stance was that there’s no point in trying to prevent copying, as it’s so easy to do – and is only getting easier. It is so easy to violate the artist’s choice, why bother respecting the rules that protect that choice? However, there are many things that are easy to do, yet are not legally or morally right – for instance, posting anonymous threats saying you’d like to kill someone.

I’m not sure exactly what the rhetorical classification of that riposte is, but I think it’s a little bit reductio ad Hitlerum; comparing the copying of digital media to sending death threats is not exactly proportional in ethical terms. An attention-grabbing way to begin, though, I’ll grant you.

Just because an illegal act is easier to commit on the web, in the comfort of an anonymous mob, than in the physical world where there is a greater likelihood of apprehension doesn’t mean that our laws and ethics should somehow be suspended.

The ease of duplication is little to do with the anonymity of the web, it’s a function of the infinitely reproducible and lossless nature of digital media. Thumb-drive  sneakernet party, anyone? Exactly the same problem arose from the proliferation of cassette tapes, albeit a slower and more lossy version thereof… and the music industry defeated that problem very neatly with the compact disc. Laws and ethics shouldn’t be suspended, no; nor should the need for businesses to innovate if they wish to stay profitable.

Producing a record – as opposed to writing most books – tends to be a team effort involving a producer (sometimes several of them) and songwriters who are not part of the act, studio engineers and a whole host of people who don’t earn money from merchandise and touring – people who no one would pay to make personal appearances.

I’m sure there’s a lot of editors, agents, proofreaders, copyeditors, cover artists, layout geeks and beta readers who’ll be astonished to realise that their contribution to the production of a novel is effectively negligible. But then they’re mostly busy trying to figure out how to make their careers survive the transition to digital, so perhaps we can forgive them that oversight.

Many songwriters and producers I know have been excited about getting their songs recorded, only to see it given away as a free digital download by the artist or label. Though it may help promote the artist it does nothing to promote these writers and producers, as downloads don’t display any credits.

Surely that oversight is the fault of the label’s implementation of the free give-away, rather than the free give-away itself? The producer or writer chose to sign the contract that allowed the label to do it, right? Caveat creator; if you choose to go to bed with the money-men, you must live with the consequences. Likewise, if you make your own choices about whether to give your stuff away, you must sleep in the bed you made for yourself. Take responsibility for your own career, or don’t; simple choice, really.

Another argument used by proponents of the “free” business model is that record labels have mistreated artists for decades and so deserve to go out of business – so to them I guess two wrongs make a right.

Not sure I see where that second wrong is, here; in fact, it strikes me that the collapse of the record labels is a consequence of their own failure to act. No one is actively threatening the record label business model, it’s simply failing to adapt to a changing environment. Evolve or die. I’ll certainly cop to feeling a certain amount of schadenfreude over the demise of the big labels, but that’s probably because I’ve listened to sermons in the Church of Albini. Your karma just ran over your dogma; it’s not two wrongs making a right, it’s cause and effect. Lose public trust, lose your business.

I signed my first publishing deal almost 10 years ago with BMG, who ended up being bought by Universal. Sure, I’ve had my issues with them through the years. Yet I don’t regret signing with them as they provided me, an unproven songwriter, with the means to write music full time (I’m sure authors can relate) and develop my craft.

“I got a great deal out of my signing, therefore all signings are fair.” I refer the honourable lady once again to the Church of Albini. Perhaps his numbers there represent an equally rare but opposite polar extreme… but having spent most of my adult life around working and/or aspiring musicians, I rather suspect it isn’t.

They’ve even agreed to give the songs that haven’t yet been covered back to me – despite not having to, contractually.

Very rare, if I’m not mistaken, and a comparatively recent development; music history is littered with lawsuits by bands and songsmiths great and small who fought – often unsuccessfully – for the ownership of their own material (paging Jello Biafra). But bravo, BMG; perhaps this will become a blanket policy for all artists you sign, and all the artists you’ve signed before?

… others would argue that the principle of CC licensing is simply to give creative works away for free in what Lessig calls the “hybrid economy”. Giving away the works benefits the owners of the distribution platform, such as Flickr, YouTube or Google, not the individual creators licensing their works under Creative Commons.

And selling the works of musicians benefits the shareholders of the record companies – so where’s the difference? No one is forced to license their material as CC; no one is forced to use any particular platform to store and share their work… and there’s the difference. There’s a lot less choice once you’ve signed your contract with Sony BMG, I’m guessing. They get to make all those decisions on your behalf… and I’m sure they’ll have your best interests foremost in their minds as they do so.

And there are other issues. For instance: what constitutes “non-commercial”? Selling YouTube for $1.65bn? Selling Flickr for $35m?

“Web-based media sharing platforms in profit-making shock horror probe!” I’m pretty sure HMV and Tower Records and Amazon were always pretty interested in making a profit, too… but again, the artist didn’t get a choice about where their material ended up being sold (and, subsequently, who ended up getting a cut of the sales price). It’s a bit weird to argue for art as a commercial endeavour and then criticise proponents of a different model for using commercialised distribution channels… how shameful of them to compromise with the capitalist world around them in a way that lets their work be seen on their own terms! Hypocrites!

I believe a successful future for content creators consists of a combination of solutions, one of them being unlimited ISP music subscriptions bundled in with their broadband access deals.

I have some sympathy with this idea, as it happens, but it has all sorts of potential loopholes through which record labels can get themselves back to steady-income business-as-usual; I believe this is a process commonly referred to as “protectionism”. And hey, wait a minute – some of those ISPs are big profit-making businesses! So they’re exploitative middlemen in exactly the same way as YouTube and Flickr, are they not?

I believe it’s detrimental to suggest that creators should be defeatist and not participate in this evolution – that what they’ve created has no value so they may as well give it away.

While there’s a lot of ways to interpret Doctorow’s stance, suggesting that he’s telling creators to “not participate in [the] evolution” of the markets in which they wish to place their work is not one that I can reach with any logical train of thought; quite the opposite, in fact.

Indeed, I’d have thought that saying “leave it to the labels, the ISPs and the government to fix” was much closer to that doctrine… but hey, I give my work away on the internet, so I doubtless got brainwashed long ago. *shrug*

The ethics of content theft in a digital world

Here’s a simultaneously wry and astute post from novelist Philip Palmer about the publishing industry’s new here-to-stay bugbear, digital piracy. What I like most about it is the blend of idealism and honesty; rather than simply stating that Piracy Is Wrong And Evil And Makes Jeebus Cry, he’s willing to objectively assess his own moral code as applied to evading cost on the media he wishes to consume.

Before we get to the meat, though, I’m going to call out one item for criticism, because it’s such a well-used semantic straw man that by this point that it gets repeated as a matter of fact:

… there are many thoughtful individuals out there, possessed of shitstorm-generating superpowers,  who do believe that EVERYTHING SHOULD BE FREE ON THE WEB.

I tend to think of this as The Doctorow Rejoinder, because it’s usually Cory that’s the target (implied or otherwise) of that complaint. But here’s the thing: it’s bollocks.

Sure, there are people out there who believe everything should be free on the web… and sure, those people are pretty stupid (or extremely idealistic and ignorant of the most basic tenets of economics). However, the “shitstorm-generators” that Palmer refers to – the ones with any real influence at all, rather than the lip-flapping skriptkiddiez who requote them out of context on their warez blogs – do not believe (or at least do not publicly claim) that “everything should be free on the web”.

People are always reminding me about how Cory Doctorow believes and preaches that; however, not one of them has yet been able to show me a citation where he does so. Doctorow happily and truthfully claims that free content has worked for him, and explained the potential benefits of such a business model to people in similar positions, but he’s never (to my knowledge) claimed free content as a) a panacea to the struggles of the obscure artist/creator or b) the road to an inevitable digital syndicalist utopia where everything necessarily costs nothing. (I’m quite willing to be proved wrong on this point, but I want citations from original source material, not flimsy op-eds from folk with axes to grind or political capital to reap.)

So, let’s be clear: no one worth arguing with has ever claimed that “everything should be free on the web”; until we get past this particularly tenacious straw man, we’re going to struggle to deal with the real issues. And so, it’s back to Philip Palmer’s otherwise sound essay. A few quotey bits:

I think it’s worth pointing out that there’s nothing new under the sun.  The digital age didn’t invent plagiarism; nor did it invent piracy.  The web changes many things; but not basic questions about right or wrong; it merely AMPLIFIES the problems that always existed

Book piracy, for instance,  was pioneered by the public library service.  For many years, until the advent of PLR, it was considered moral and normal to give away books for zero money on a rental basis to members of the public.  This is a great way to impoverish authors.  Because a book that’s been borrowed a hundred times has only been bought once!

Second hand bookshops!  They are the buccaneers of the book trade. A second hand book may be sold a dozen different times but again,  the author only gets paid once.  We authors notice these things.

So illegally downloading books is no different, in principle, than going to Hay-on-Wye.  Fact!

Yes, that’s a sophistic argument; that’s Palmer’s point, I think. Now, here’s where it gets interesting:

When I started getting published I stopped buying second hand science fiction novels from authors still alive or not-rich.  So I’ll buy second-hand Stephen King, though only occasionally,  but I’d never buy Al Reynolds’  latest in a second hand bookshop, because  he’s a real writer earning a living. I do though buy all my Edgar Rice Burroughs’ Barsoom novels (my current passion)  second hand via Amazon, mainly because the old Del Rey editions are so stunning, and I’m pretty sure they’re out of print.

So that’s my moral code, based on the opinion that borrowing books from a pal and illegally downloading books are pretty much the same thing, ethically speaking. In other words, it’s okay to get stuff free sometimes, as long as you OFTEN pay.

Palmer’s point is that (with very few exceptions) we don’t have unlimited funds for buying entertainment, but we have a close-to-unlimited hunger for the stuff, and so we all come to our own ethical compromise with the world; Palmer puts money in the pockets of living authors who he feels deserve it, but he doesn’t want to contribute to Stephen King’s retirement nest-egg, nor send money to middle-men reprinting the works of the long-dead if he has a cheaper option available to him. He’s obeying the spirit of the piracy laws, though not necessarily the letter of them.

I take a similar approach to music, as do many people I know; I’m – by my own admission – a somewhat skewed data-point (because as a reviewer I get sent a lot of legitimate freebies) but I download hard-to-find and/or costly albums without too many qualms because I attend dozens of live shows every year, buy merchandise, patronise live music venues, buy music equipment and use rehearsal spaces. I’m paying my way within that economic sphere, and doing so with a fairly significant portion of my disposable income.

There are those who don’t pay their way, certainly, but I suspect they’re a minority; digital music recordings are valueless unless you want to listen to them. I can’t imagine many folk bother downloading albums just to consume hard drive space and have a longer list in their media player library; you collect music because you’re passionate about it, and if you’re passionate about music you probably go and see it played live if you have the opportunity to do so.

Digital media is a non-rival good; to take it for free is not theft but evasion of cost, and evasion of cost is a fundamental tenet of economic behaviour (with the possible exception of those with more money than sense); economic behaviour is not rational but emotional, and basing your response to a change in the underpinnings of an industry’s economy on the hope that you can stop human beings behaving in the ways they always have done is to doom yourself to failure. Successful businesses work out ways to monetise desire, but business models do not last forever; if they did, there wouldn’t be an internet (or cars, or electricity, or, or, or). QED.

This is a point borne out in the music industry, where – in spite of the withering of the recording companies – overall profits are actually growing consistently: live show tickets, merchandise, new instruments and recording technology, all selling better than they ever have before. There are studies based on the industry’s own figures that show heavy downloaders of music torrents spend more on legitimate content purchases than those who buy a few albums every year. Illegal downloading is not “killing music” (just as home-taping didn’t “kill music”); it’s killing a business model, and the record labels really don’t have anyone other than themselves for failing to adapt to a changing landscape.

As I’ve mentioned before, the publishing industry appears to have wised up faster than the record labels did, but it’s interesting to note that – as with the music industry – the smaller more artist-centric outfits are the ones who seem to be most willing to try new options. The more profitable the old model was, the greater the inertia of those who profited from it. Evolve or die.

This is the point where I usually get accused of celebrating the fact that it’s getting harder and harder for artists of all stripes to make money from their work. To which I respond: pointing out the realities of the situation, and the fact that all the idealistic thinking in the world won’t stop consumers behaving as they do (namely getting something they want as cheaply and conveniently as possible), is not celebratory; it is a matter of pragmatism.

The genie will not go back in the bottle; it is more productive to work out ways to cope with the genie’s freedom than it is to build elaborate doomed-to-fail genie entrapment devices, or to repeat idealistic platitudes about how the bottle shouldn’t have been opened in the first place and look for someone to blame for it. Yes, it sucks that the business models of many creators whose work I adore and wish to support are under economic pressure; however, no amount of me (or anyone else) saying how much it sucks will make a damned bit of difference. Play the hand you’re dealt, or fold and get out of the game.

A harsh thing to say, perhaps, given I’m a friend of (and contractor to) a number of authors… but would you want your doctor to lie about a life-threatening illness? If you want to survive, you have to accept the reality of the situation, take the pills, endure the surgery; I can’t help but think that content creators as a demographic are moving slowly through the five stages of grief psychology with respect to the economics of infinite goods. It’s a painful and necessary process, but acceptance is the only end-point from which you can move on.

In an ideal world, we’d all be paid enough in return for doing something we loved to have everything we wanted. If anyone has directions on how to get to that ideal world, by all means please let me and everyone else know how to join you there; in the meantime, I think we’re best off concentrating on finding a way to make a living here in reality.

Rumours of the novel’s death, etc etc

I guess we’re gonna keep hearing this particular riff until the day they close the last printing press on the planet, but hey – the handwringing of the literati never gets old, right? [via BigThink]

The tyranny of choice is a near-universal digital lament. But for literary authors, at least, what comes with the territory is an especially barbed species of uncertainty. Take the award-winning novelist and poet Blake Morrison, perhaps best-known for his memoir And When Did You Last See Your Father? “I try to be positive about new technology,” he told me, “but I worry about what’s going to happen to poetry books and literary novels once e-readers have taken over from print. Will they survive the digital revolution? Or will the craving for interactivity drive them to extinction? I’ve not written anything for a year, and part of the reason may be a loss of confidence about the future of literary culture as I’ve known it.”

Great solution, Mr Morrison, very Gen X of you: can’t win, so why try? Put In Utero on your stereo, stare out of the window for a while, read some Doug Coupland; that’s sure to work. Literary novels have long made genre’s sales figures look epic by comparison, and poetry – in its written-and-printed form, at any rate – has been in recession since before I was born. Horse, barn door, yadda yadda; bit late to be worrying about relevance, really.

Snark aside, the rest of the article is actually a pretty decent “what’s coming down the pike” sort of piece; not a great number of new ideas in there (at least not to me, and probably not to most regulars here at Futurismic), but a good synthesis of the current state-of-play:

Above all, the translation of books into digital formats means the destruction of boundaries. Bound, printed texts are discrete objects: immutable, individual, lendable, cut off from the world. Once the words of a book appear onscreen, they are no longer simply themselves; they have become a part of something else. They now occupy the same space not only as every other digital text, but as every other medium too. Music, film, newspapers, blogs, videogames—it’s the nature of a digital society that all these come at us in parallel, through the same channels, consumed simultaneously or in seamless sequence.

Personally, I see this as a liberation for the novel, though I’d be a fool to deny it’ll be hugely transformative.

There are new possibilities in this, many of them marvellous. As the internet has amply illustrated, words shorn of physical restrictions can instantly travel the world and be searched, shared, adapted and updated at will. Yet when it comes to words that aim to convey more than information and opinions, and to books in particular, a paradoxical process of constriction is also taking place. For alongside what Morrison calls “the craving for interactivity,” a new economic and cultural structure is arriving that has the power to dismantle many of those roles great written works have long played: as critiques, inspirations, consciences, entertainments, educations, acts of witness and awakening, and much more.

Which isn’t so much the death of the novel as it is the death of pre-digital hierarchical culture itself, really; the novel is but a small appendage of that withering body.

The strength of the article is that it admits what many of the others seem to shy away from: that the publishing landscape has been changing for a long time, and this is just the latest phase of that inherently market-driven mutation. Long tail ahoy!

This interplay is highly significant within a book market that—even leaving aside the torrent of self-publishing that digital technology permits—has become increasingly crowded and top-heavy. In 2009, more books were published in Britain than in any previous year in history: over 133,000. And yet just 500 authors, less than half of 1 per cent, were responsible for a third of all sales. The situation is an order of magnitude more extreme than that of 30 years ago, when fewer than 50,000 books appeared. In America, one out of every 17 novels bought since 2006 has been written by the crime novelist James Patterson.

This simultaneous increase in the diversity of titles and the concentration of profits among a small number of “super authors” is of a piece with cultural trends elsewhere. And Patterson’s success—in 2009 he netted a reported $70m (£44m) from writing—is both an emblem of how the book trade has changed during several decades of corporate consolidation, and of how it is likely to continue evolving.

Patterson’s “writing” process pretty much buries any romantic notion of the novelist as pure artist; that’s not to say he doesn’t care about what comes out under his name, but he’s realised that there’s a certain direction he can head in that will net him more money than the others. Nothing to stop you or Blake Morrison writing literary novels and poetry, of course; you just need to accept that, like the few buggy-whip manufacturers still in business, you’re catering to a niche, and as such your annual balance sheets aren’t going to look like those of General Motors.

And if anything, the ubiquity and portability of the written word in a networked world makes your chances of finding an audience much higher than the days when dead-tree was your only option. Granted, turning a profit from that audience is a trick that awaits perfecting… but it’ll come.

#50cyborgs postmortem

I hope you’ll indulge me as I link to this postmortem interview with Tim Maly about his #50cyborgs project; yes, both Maly and interviewer Matthew Battles say nice things about my own contribution to it, but it’s also an interesting discussion for anyone curious about the future of “positioning for niche intelligentsia eyeballs in the modern post-blogosphere”, as Bruce Sterling puts it… or, to put it another way, content creation targeting select narrow verticals of the geek market.

MB: A striking aspect of the reaction to 50 Cyborgs was its seriousness. I mean, often when mainstream media outlets cover Internet culture, they talk about how wacky or geeky it is. And yet here was a project wholly of the Internet, which could be treated in venues like the Atlantic or on Nora Young’s CBC show as a serious project full-stop.

TM: It’s interesting that you find this striking. It never occurred to me that it was anything other than a good idea that they should cover it. The Atlantic comes out of me knowing Alexis through Twitter. When I first started talking about the 50th anniversary, he was at Wired and we’d talked about how it might be structured. When he moved over to The Atlantic, the idea moved with him.

As for CBC, I just sent them an email. Spark has always been very open to and about taking the Internet seriously. Right there on the homepage, it says, “Spark is a blog, radio show, podcast and an ongoing conversation about technology and culture. Spark is an online collaboration. Leave your thoughts, stories, and ideas here, and together we’ll make a radio show.” How could I not get in touch?

There is a power in boldness, it seems… though connections sure are helpful, too. But #50cyborgs spread as wide as it did in a fairly organic way:

MB: Beyond the handcrafted mediasphere of rss and podcast, though, an Internet culture project that isn’t about privacy, piracy, or kittens can be hard to find on the mainstream radar screen. How did you court the attention of the wider media?

TM: I didn’t. I reached out to sites that I thought would be interested in the project. The thing about mainstream media is that a lot of it moves too slowly. The gap between me being some weirdo with a Tumblr account and a good idea and the successful completion of the project is shorter than the lead time of most magazines.

I thought about approaching the New York Times about it as they are the first mention of the word (cyborg), as far as I can tell. I ended up not finding the time. The coverage in the Guardian came off of the author, Caspar Llewellyn Smith, hearing the Spark podcast.

I was more interested in hitting the big aggregators. I didn’t have as much success there as I’d hoped, though hitting Slashdot, Reddit and io9 felt pretty good. io9 was especially thrilling because I was in the midst of trying to work out how best to pitch to them and Annalee contacted me asking if there was room for one more contributor. And then she pitched “cyborgs in love”, which was on my unclaimed coverage wishlist. I hadn’t yet sent anything in and here’s the editor in chief getting in touch with me!

Lots of food for thought in there… and, for me, memories of a proud moment and a fun project. 🙂
